1. Purpose of this dashboard

This dashboard ("the Dashboard") is provided by Cooltree B.V. ("Cooltree", "we", "us"), with its registered office in the Netherlands, to the recipient organisation ("the Client") as part of an ongoing advisory engagement. It is intended for internal use by the Client and its authorised representatives only and serves as a working tool to support sustainability data management, GRESB preparation, and portfolio decarbonisation.

The Dashboard is not a public document, not a regulatory submission, and not a substitute for the Client's own books, records, or filings.

2. Indicative nature of the information

All scores, rankings, percentages, energy intensities, completeness indicators, gap counts, GRESB estimates, ASHRAE thresholds, peer comparisons and similar metrics shown on the Dashboard are indicative and derived from automated processing of third-party and Client-supplied data. They are intended to highlight areas that may warrant attention; they are not authoritative measurements, certified results, audit conclusions, or final assessment outcomes.

In particular:

  • GRESB-related figures are estimates produced by Cooltree's models. They are not endorsed by, affiliated with, or representative of the official scoring of GRESB B.V. or any other benchmark body. Final GRESB scores are determined exclusively by GRESB following its own validation process.
  • Energy and emissions intensities are calculated from data exported from third-party platforms (in particular Scaler) and may include estimated, normalised, or extrapolated values. They are not measured values and may diverge materially from utility-bill or audit data.
  • Coverage, completeness, and "score" metrics reflect the data available to Cooltree at the moment of the latest pipeline run; they are not statements about the underlying performance of any asset or portfolio.
  • Peer benchmarks and outliers are computed from limited samples and should not be interpreted as statistically robust comparisons.

3. No advice; no rights

The Dashboard does not constitute investment advice, legal advice, tax advice, accounting advice, regulatory advice, sustainability assurance, or any other form of professional advice. It is not an offer or recommendation to buy, sell, hold, finance, divest, retrofit, or value any asset.

No rights may be derived from the content of this Dashboard. The Client and any other reader remain solely responsible for their own decisions and should obtain independent professional advice before acting on any information shown here.

4. Source data and accuracy

The Dashboard is built from data supplied by the Client, by third-party platforms (including but not limited to Scaler, GRESB, EU and national benchmark datasets, and certificate registries), and from publicly available sources. Cooltree relies on the accuracy and completeness of those sources and does not independently verify the underlying data unless explicitly agreed in writing.

Source data may contain errors, gaps, time lags, methodology changes, or revisions. Figures shown in the Dashboard reflect the state of those sources at the time of the most recent pipeline run and may change without notice when new data is ingested.

5. Limitation of liability

To the maximum extent permitted by Dutch law, Cooltree, its directors, employees, contractors, and affiliates exclude all liability for any direct, indirect, incidental, consequential, or special loss or damage – including but not limited to lost profits, lost opportunities, reputational harm, regulatory exposure, financing impact, valuation impact, or third-party claims – arising out of or in connection with:

  • the use of, or reliance on, the Dashboard or any figure shown on it;
  • any inaccuracy, omission, or delay in the source data;
  • any unavailability, interruption, or change of the Dashboard;
  • any decision made by the Client or a third party on the basis of the Dashboard.

This limitation applies in addition to – and does not replace – any limitation of liability already agreed between Cooltree and the Client in the underlying engagement contract or applicable general terms.

This exclusion does not apply to liability for damage caused by Cooltree's intent (opzet) or deliberate recklessness (bewuste roekeloosheid) on the part of Cooltree's management, in line with mandatory Dutch law.

6. Intellectual property and confidentiality

The Dashboard, including its design, structure, methodology, models, scoring logic, and the underlying code and content, is the intellectual property of Cooltree and/or its licensors. The Client receives a non-exclusive, non-transferable right to use the Dashboard for internal purposes for the duration of the engagement.

The Client shall not – without Cooltree's prior written consent – publish, redistribute, sublicense, or share the Dashboard or any non-trivial extract from it with parties outside the Client's organisation, save for the Client's professional advisors who are bound by a duty of confidentiality.

Third-party trademarks (including "GRESB", "Scaler", "ASHRAE", and benchmark or certification marks) remain the property of their respective owners and are used here for identification only.

7. Personal data

The Dashboard is designed to display portfolio-level and asset-level operational data and is not intended to contain personal data within the meaning of the GDPR (Regulation (EU) 2016/679) / UAVG. Where the Client supplies data that incidentally contains personal data (e.g., contact names, occupant references), Cooltree processes such data as a processor on behalf of the Client under the terms of the engagement contract and any applicable data processing agreement.

8. Changes

Cooltree may update, expand, restructure, or discontinue the Dashboard, and may revise the methodology, definitions, weightings, and scoring rules used in it, at any time and without prior notice. Historical figures may be recomputed under updated methodology and may therefore differ from previously displayed values.

9. Governing law and jurisdiction

This disclaimer and any non-contractual obligations arising from or in connection with the use of the Dashboard are governed exclusively by the laws of the Netherlands. Any dispute will be submitted exclusively to the competent court in Amsterdam, the Netherlands, without prejudice to Cooltree's right to bring proceedings before any other court of competent jurisdiction.
